Modu Terms of Use
These public terms cover the Modu website, meeting requests, trial access, and use of the Modu service. A signed order form or commercial agreement may add product scope, pricing, support, service levels, and other terms. If they conflict, the signed agreement controls.
1. Accounts and authorized users
You must provide accurate information, protect login credentials, and use the service only for the business you are authorized to represent. You are responsible for activity under your accounts and for assigning appropriate access to staff.
2. Merchant responsibilities
You remain responsible for your catalog, prices, taxes, promotions, customer communications, food and product information, order acceptance, refunds, and compliance with applicable rules. Modu is an operations tool and does not replace professional legal, tax, accounting, food-safety, or compliance advice.
3. Payments, delivery, and third parties
Payment processing, maps, messaging, delivery, and other integrations may be supplied by third parties and depend on their approval, coverage, uptime, and terms. Fees, settlement timing, cancellations, refunds, and delivery responsibility are confirmed during onboarding or in the applicable commercial agreement.
4. Acceptable use
Do not use Modu unlawfully; submit false or abusive requests; access another customer’s data; bypass security or usage limits; disrupt the service; introduce malicious code; scrape protected areas; or copy, resell, or reverse engineer the software except where law expressly permits.
5. Data and privacy
You keep ownership of business and customer data you provide. You authorize Modu and its approved service providers to process that data as needed to deliver, secure, support, and improve the contracted service. Do not upload data you are not entitled to use. Contact us to request access, correction, or deletion where applicable.
6. Availability and changes
We work to keep Modu reliable and secure, but uninterrupted availability is not guaranteed unless a signed agreement states a service level. Features may change to improve safety, reliability, legal compliance, or product operation. We will give reasonable notice of material changes when practical.
7. Intellectual property
Modu software, branding, interface, documentation, and product design remain owned by Silsal or its licensors. Your limited right to use the service ends when the applicable subscription or agreement ends. Third-party names and marks belong to their owners.
8. Suspension and termination
Access may be limited or suspended for security risk, unlawful use, material breach, non-payment, or harm to the service or others. Data export, retention, and deletion after termination follow the signed agreement and applicable legal requirements.
9. Liability
To the extent permitted by applicable law, Modu is provided without implied guarantees beyond those expressly agreed in writing. The signed commercial agreement governs warranties, indemnities, liability limits, dispute handling, and governing law.
